Melody’s Products or Services (delivered by Melody and / or under ‘Sophia of Sound’ are not meant to be a substitute for professional advice from your professional care provider and Melody makes no warranties, express or implied, as to the completeness, accuracy, or appropriateness for any purpose of any information or instruction provided through the Services. You are encouraged to consult with your healthcare provider or other professional care provider with any questions or concerns you may have regarding any health condition or any other condition that you may have before taking any action or engaging in any activity or program, including Melody’s Services. You acknowledge and agree that when taking any action, booking a service, or participating in any activity, routine or program that may be described in the Services and offerings, you assume possibility of physical or emotional risk and take full personal responsibility for any outcomes.

REFUND POLICY. Orders, bookings and events are non-refundable however reschedules for services are offered with 48 hours notice. After 48 hours unfortunately we can no longer offer a rescheduling option.

Subject to your compliance with these Terms, we hereby grant you a limited, non-exclusive, non-transferable, and sub-licensable, and revocable right to access, view, and use the Site solely for your personal purposes and non-commercial use, and as we otherwise intend. Sophia of Sound reserves the right to monitor the Services and Content for the purpose of determining that your usage complies with these Terms.

You may not modify, publish, transmit, participate in the transferor sale of, reproduce, create derivative works of, distribute, publicly perform, publicly display, or in any way exploit any of the materials or Content on our Site in whole or in part, other that as necessary for your own personal non-commercial use, without our written consent. Modification of the Content or use of the Content for any other purpose is a violation of the copyright and other proprietary rights of Sophia of Sound, as well as other authors who created the materials, and may be subject to monetary damages and penalties.

Terms of Purchase for digital goods & services

These Terms of Purchase for Digital Goods and Services ("Terms") are between you ("Purchaser," "you," "your") and Sophia of Sound company. ("Company," "we," "us," "our") and govern your purchase of digital products, audio files, songs, services and related content (collectively, the "Products") through the Company's website at www.sophiaofsound.com or any related domains or subdomains (the "Website"), or in person.

By purchasing or downloading any Product from this Website, clicking "Add to Cart," "Buy Now," "Download" or any similar purchase button, submitting payment electronically or in person, or otherwise subscribing or enrolling through the Website, you ("Purchaser," "you," "your") agree to be bound by these Terms together with our Website Terms and Conditions, which are incorporated by reference (collectively, the "Agreement"). If there is any conflict between these Terms and the Terms and Conditions, these Terms will control with respect to the purchase and use of Products. If you do not agree, please do not purchase or download our Products.

DIGITAL PRODUCT DELIVERY

  • Delivery Method: Upon successful completion of your payment, you will receive an email containing a link to download your purchased Product, or you will be redirected to a download page.

  • Download Limitations: Download links are valid for 24 (twenty-four) hours from the time of purchase. If you click an expired link, a new link to the email address used for the initial purchase will be sent.

  • Technical Requirements: You are solely responsible for ensuring you have the appropriate hardware, software, and internet connection required to download and play the Products (typically delivered in MP3 / WAV format).

INTELLECTUAL PROPERTY & OWNERSHIP

  • Retention of Rights: All audio, music, lyrics, master recordings, artwork, and underlying compositions contained within the Products are the exclusive intellectual property of Sophia of Sound and are protected by copyright laws.

  • No Transfer of Ownership: The purchase of a Product grants you a limited license to use the audio; it does not transfer ownership, copyright, or any proprietary rights to you.

END-USER LICENSE (PERSONAL USE ONLY)

By purchasing a Product, you are granted a limited, non-exclusive, non-transferable, revocable license to use the audio file strictly under the following conditions:

  • Permitted Use: You may play the song for personal, private, non-commercial entertainment on your personal devices.

  • Prohibited Uses: You strictly MAY NOT:

    • Resell, redistribute, lease, license, sub-license, or give away the audio file to any third party.

    • Upload the Product to public file-sharing sites, YouTube, SoundCloud, or any streaming platforms.

    • Use the audio file as a soundtrack in commercial or non-commercial media (e.g., YouTube videos, indie films, video games, advertisements, podcasts) without purchasing a separate Commercial Sync License.

    • Sample, remix, edit, alter, or create derivative works from the audio file.

REFUND AND CANCELLATION POLICY

  • All Sales Are Final: Due to the digital and irrevocable nature of downloadable products, all sales are final. Once a download link has been generated or accessed, we cannot issue refunds, returns, or exchanges.

  • Exceptions: If you experience a technical issue with your file (e.g., the file is corrupted) and notify us at hello@sophiaofsound.com within 14 days of purchase, we will attempt to fix or replace the file. If we cannot resolve the technical defect, a refund may be issued at our sole discretion.

LIMITATION OF LIABILITY

  • "As-Is" Basis: The Products are provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied.

  • No Liability for Damages: To the maximum extent permitted by law, Sophia of Sound shall not be liable for any direct, indirect, incidental, or consequential damages resulting from your use of, or inability to use, the Products, including but not limited to device damage, data loss, or system errors.

AVAILABILITY AND PRICING

Sophia of Sound reserves the right to change the prices and available Products and Services at any time. Quantities of some Products and Services may be limited and stock cannot always be guaranteed. Products and Services offered for sale on this Site are for sale globally and all prices are quoted in U.S. dollars. We may occasionally make errors in the stated prices on this Site. If a product’s correct price is higher than the listed price, we will, in our discretion, either confirm the correct price with you or cancel your order and notify you of such cancellation.
